By accessing or using our English language learning application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Our Service is a Software as a Service (SaaS) platform designed to help users learn English through vocabulary list creation and AI-powered exercises. The Service includes:

  • Vocabulary list creation and management
  • AI-generated exercises including:
    • Fill in the blanks
    • Multiple choice questions
    • Word generation with examples
    • Example generation for user-created vocabulary
  • Token-based AI functionality system
  • Subscription-based access tiers

4. User Accounts and Registration

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Be responsible for all activities under your account

4.2 Account Eligibility

You must be at least 13 years old to use the Service. Users under 18 must have parental consent.

5. Subscription Plans and Pricing

5.1 Available Plans

  • Free Plan: $0/month with limited features
  • Basic Plan: $12/month (monthly billing) or $10/month (yearly billing)
  • Premium Plan: $24/month (monthly billing) or $20/month (yearly billing)

5.2 Token System

All AI-powered features consume tokens. Each plan includes a monthly token allocation that renews monthly. Additional tokens can be purchased:

  • 50,000 tokens: $1
  • 400,000 tokens: $5
  • 1,000,000 tokens: $10

5.3 Billing and Payment

  • Subscriptions are billed in advance on a monthly or yearly basis
  • Payments are processed through secure third-party payment processors
  • All fees are non-refundable except as required by law
  • We reserve the right to modify pricing with 30 days' notice

5.4 Auto-Renewal

Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings.

6. Use of AI Features

6.1 Token Consumption

AI features consume tokens from your account balance. When tokens are exhausted, AI features become unavailable until:

  • Your monthly allocation renews, or
  • You purchase additional tokens

6.2 AI Content Accuracy

While we strive for accuracy, AI-generated content may contain errors. Users should verify information independently, especially for academic or professional purposes.

7. User Content and Conduct

7.1 User Content

You retain ownership of content you create (vocabulary lists, notes, etc.). By using the Service, you grant us a license to use, store, and process your content to provide the Service.

7.2 Prohibited Uses

You agree not to:

  • Use the Service for illegal purposes
  • Attempt to reverse engineer or hack the Service
  • Share your account credentials
  • Upload malicious content or spam
  • Violate intellectual property rights

8. Intellectual Property

8.1 Service Ownership

The Service, including all software, content, and materials, is owned by us and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

9. Data Protection and Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs the collection and use of your information.

10. Service Availability

10.1 Uptime

We strive to maintain high service availability but do not guarantee uninterrupted access.

10.2 Maintenance

We may perform scheduled maintenance that temporarily affects service availability. We will provide reasonable notice when possible.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SERVICE IN THE PAST 12 MONTHS

12. Termination

12.1 By You

You may terminate your account at any time through account settings.

12.2 By Us

We may terminate or suspend your account for:

  • Violation of these Terms
  • Non-payment of fees
  • Fraudulent activity
  • Legal requirements

12.3 Effect of Termination

Upon termination, your right to use the Service ceases. We may delete your data after a reasonable period.

13. Modifications to Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance of new Terms. Material changes will be communicated via email or Service notifications.

14. Governing Law

These Terms are governed by Polish law. Disputes will be resolved in Polish courts.

15. Severability

If any provision of these Terms is deemed invalid, the remaining provisions remain in full effect.
